Terms of Service

These Terms of Service ("Terms") govern your access to and use of PixoKit, an AI-powered product photography platform operated by Zorever EcomTech Private Limited ("PixoKit", "we", "us", or "our") and available as a Shopify application.
By installing, accessing, or using PixoKit, you ("you", "your", or "Merchant") agree to be bound by these Terms. If you do not agree, do not install or use PixoKit.

2. Service Description
PixoKit is an AI-powered product photography service that enables Shopify merchants to generate professional product images using artificial intelligence. Our services include:
- Background Replacement — Replace product image backgrounds with AI-generated scenes
- Background Removal — Remove backgrounds to create transparent PNG images
- Virtual Try-On — Generate images of AI models wearing your products
- Color Variants — Generate product images in different colors
- AI Model Creation — Create reusable AI brand models for virtual try-on
- Multi-Platform Export — Export generated images optimized for Shopify, Amazon, Instagram, and other platforms
- Brand Kit — Configure brand preferences for consistent AI-generated images
- Push to Shopify — Send generated images directly to your Shopify product media gallery
3. Account and Eligibility
3.1 Eligibility
You must be at least 18 years of age and have the legal authority to enter into these Terms on behalf of yourself or the business entity you represent. PixoKit is intended for use by Shopify store owners and their authorized representatives.
3.2 Account
Your PixoKit account is created automatically when you install the app through the Shopify App Store and authorize access via Shopify OAuth. You are responsible for maintaining the security of your Shopify account and all activity that occurs under your account.
3.3 Shopify Requirements
PixoKit requires an active Shopify store. Your use of Shopify is governed by Shopify's own terms of service. We are not responsible for any changes, outages, or actions taken by Shopify.
4. Credit System
4.1 How Credits Work
PixoKit operates on a credit-based system. Each AI generation feature costs a specific number of credits:

Credit costs are subject to change. We will notify you of any changes before they take effect.
4.2 Credit Allocation
- Credits are allocated monthly based on your subscription plan.
- A one-time signup bonus of 50 credits is provided upon first installation (no subscription required).
4.3 Credit Expiry
Unused credits expire at the end of each billing cycle and do not roll over to the next month. When your billing cycle resets, your credit balance is reset to the amount included in your active subscription plan.
4.4 Refund Policy
Credits are non-refundable once allocated. However, if a generation fails due to a system error and credits were deducted, those credits will be automatically refunded to your account.
No refunds are issued for:
- Generations that complete successfully but do not meet your expectations
- Unused credits at the end of a billing cycle
- Credits remaining at the time of cancellation or uninstall
5. Subscription Plans and Billing
5.1 Plans
PixoKit offers subscription plans at various tiers, each including a monthly credit allocation. Current plans and pricing are displayed in the app and on the Shopify App Store listing.
5.2 Billing
All billing is handled through the Shopify Billing API. By subscribing to a paid plan, you authorize Shopify to charge the applicable fees to your Shopify account. PixoKit does not directly process any payment information.
5.3 Plan Changes
You may upgrade or downgrade your plan at any time through the app without contacting support. Changes take effect according to Shopify's billing cycle.
5.4 Free Trial
Paid plans may include a free trial period. During the trial, you receive full access to the plan's features and credit allocation. If you do not cancel before the trial ends, you will be automatically charged for the plan.
5.5 Cancellation
You may cancel your subscription at any time. Upon cancellation:
- Your access continues until the end of the current billing cycle.
- Your credit balance resets to zero at the end of the current billing cycle.
- No new credits are allocated.
- You may continue to view your generated images in the gallery but cannot create new generations.
- Generated images remain accessible until you uninstall the app.
6. Intellectual Property
6.1 Your Content
You retain all rights to the product images and content you provide to PixoKit for processing. You represent that you have the necessary rights to use any images you submit.
6.2 Generated Images
You own the AI-generated images created through PixoKit using your products, credits, and preferences. You are free to use, modify, distribute, and commercially exploit the generated images without restriction.
6.3 Limited License to Us
By using PixoKit, you grant us a limited, non-exclusive, royalty-free license to:
- Process your images as necessary to provide the service
- Use anonymized generated images (stripped of all store identifiers and merchant information) for the purpose of improving the quality of our AI services
This license does not extend to your store product catalog data. You may revoke the service improvement license at any time by contacting us at contact@zorever.com.
6.4 Our Intellectual Property
PixoKit, including its software, design, algorithms, trademarks, and documentation, is owned by Zorever EcomTech Private Limited. These Terms do not grant you any rights to our intellectual property except the limited right to use the service as described herein.
7. Acceptable Use
You agree NOT to use PixoKit to:
- Generate sexually explicit or NSFW content — including nudity, pornographic material, or sexually suggestive images
- Generate violent or harmful content — including graphic violence, gore, or content promoting self-harm
- Infringe on intellectual property rights — including using others' brand logos, trademarks, copyrighted material, or celebrity likenesses without authorization
- Create misleading or deceptive product images — including generating images that make products look drastically different from their actual appearance in a way that would deceive consumers
- Generate illegal content — including content that violates any applicable local, national, or international law or regulation, including but not limited to the laws of India, the United States, the United Kingdom, and the European Union
- Violate Shopify's Acceptable Use Policy — including any content or behavior prohibited by Shopify's terms
We reserve the right to suspend or terminate your access to PixoKit without notice if we determine, in our sole discretion, that you have violated these acceptable use terms. No credit refund will be issued for accounts terminated due to acceptable use violations.
8. AI-Generated Content Disclaimer
8.1 Output Quality
PixoKit uses artificial intelligence to generate product images. AI-generated images may not always meet your expectations. Results vary based on input image quality, selected options, and the inherent nature of AI processing. We do not guarantee specific output quality, accuracy, or suitability for any particular purpose.
8.2 Limitation of Liability for AI Output
PixoKit is not responsible for any business impact resulting from the use of AI-generated images, including but not limited to:
- Lost sales or revenue
- Brand reputation damage
- Marketplace listing rejections (Shopify, Amazon, Instagram, or any other platform)
- Customer complaints or returns related to product appearance
- Any third-party claims arising from the use of generated images
You are solely responsible for reviewing all AI-generated images before using them in your store or on any platform.
8.3 AI Disclosure
Images generated by PixoKit are produced using artificial intelligence. You acknowledge that these images are AI-generated and may choose to disclose this to your customers at your discretion. Certain jurisdictions may require such disclosure — it is your responsibility to comply with applicable laws regarding AI-generated content in your market.
9. Service Availability
9.1 No Uptime Guarantee
PixoKit is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted, timely, secure, or error-free operation of the service. We may perform scheduled maintenance, updates, or experience downtime due to factors beyond our control.
9.2 Third-Party Dependencies
PixoKit relies on third-party services including Shopify, AI processing providers, and cloud infrastructure providers. We are not responsible for any disruptions, errors, or outages caused by third-party services.
9.3 Service Changes
We reserve the right to modify, update, or discontinue any feature of PixoKit at any time. For material changes that affect your use of the service, we will provide reasonable notice.
10. Limitation of Liability
To the maximum extent permitted by applicable law:
- PixoKit is provided "AS IS" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
- In no event shall Zorever EcomTech Private Limited be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill.
- Our total aggregate liability for any claims arising out of or related to these Terms or the service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.
11. Indemnification
You agree to indemnify, defend, and hold harmless Zorever EcomTech Private Limited, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from:
- Your use of PixoKit
- Your violation of these Terms
- Your violation of any third-party rights
- Content you submit to or generate through PixoKit
- Your use of AI-generated images in your store or on other platforms
12. Data and Privacy
Your use of PixoKit is also governed by our Privacy Policy. By using PixoKit, you consent to the data practices described in our Privacy Policy.
12.1 Data on Uninstall
When you uninstall PixoKit:
- All identifiable data associated with your store is deleted within 30 days.
- Anonymized generated images (stripped of all merchant identifiers) may be retained for up to 1 year for service improvement purposes.
- Anonymized credit transaction records may be retained for up to 1 year for financial and legal purposes.
12.2 Data Portability
You may request a copy of your data at any time by contacting us at contact@zorever.com. We will provide your data in a standard format within 30 days.
13. Termination
13.1 By You
You may terminate your use of PixoKit at any time by:
- Cancelling your subscription through the app
- Uninstalling the app from your Shopify store
13.2 By Us
We may suspend or terminate your access to PixoKit at any time, with or without notice, if:
- You violate these Terms or our Acceptable Use policy
- Your Shopify store is suspended or terminated
- We are required to do so by law
- We discontinue the service
13.3 Effect of Termination
Upon termination:
- Your right to use PixoKit ceases immediately
- Unused credits are forfeited and non-refundable
- We will delete your data in accordance with our Privacy Policy and Shopify's requirements
14. Governing Law and Dispute Resolution
14.1 Governing Law
These Terms are governed by and construed in accordance with the laws of India, without regard to conflict of law principles.
14.2 Jurisdiction
Any disputes arising out of or relating to these Terms or the use of PixoKit shall be subject to the exclusive jurisdiction of the courts in New Delhi, India.
14.3 Dispute Resolution
Before initiating any legal proceedings, you agree to attempt to resolve any dispute informally by contacting us at contact@zorever.com. We will attempt to resolve the dispute within 30 days.
15. General Provisions
15.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Zorever EcomTech Private Limited regarding the use of PixoKit.
15.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
15.3 Waiver
Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision.
15.4 Assignment
You may not assign your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
15.5 Force Majeure
We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, acts of government, internet or power outages, or third-party service failures.
16. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will:
- Update the "Last Updated" date at the top of this page
- Notify you via the app or email for significant changes
Your continued use of PixoKit after any changes constitutes your acceptance of the updated Terms. If you do not agree with the changes, you should stop using PixoKit and uninstall the app.
